General terms and Conditions as of 1 oktober 2007.

On all our consultancy, offers and agreements the following terms and conditions apply:

The FENIT terms and conditions apply. The Federation of Dutch Companies in Information technology, has deposited the FENIT terms and conditions at the Griffie of the Arrondissementsrechtbank in Den Haag on 8 december 1994 under number 1994/189. A free copy of the FENIT terms and conditions and our general terms and conditions can be send up on request. ECSystems.nl also trades under the name ITProjectPartner.nl the general terms and conditions are the same.

If in any case the FENIT terms and conditions or those of the contractor (Client) conflict with any other terms of ECSystems.nl, then the FENIT terms and conditions and those of the contractor are subordinate and the general terms and conditions of ECSystems.nl prevail.

ECSystems.nl is a company with limited liability. If in any case ECSystems.nl is liable for any damages, it will only accept a one time single claim if the company insurance accepts the liability claim, up to the amount the insurer has accepted reduced by any claim free threshold.

ECSystems.nl is supplier, the customer is the contractor (Client). ECSystems.nl will endeavour to do everything to perform the task(s) to the best of it’s abilities, within the agreed parameters of time, budget and quality. ECSystems.nl will not accept liability for the correct or incorrect functioning of hardware, software and other ICT solutions not excluding back-up or corporate information, unless a legal written agreement has been drawn up, known as a SLA.

All amounts stated in offers, quotes, correspondence are in Euros and excluding Tax.

Offers and quotes are valid for 30 days, any (mayor) price change in this period is open for discussion.

Common products such as hardware and software are pre-billed. Hours are billed at the start of each month.

ECSystems.nl utilizes the warranty from the manufacturer or supplier. The maximum warranty period on any product supplied by ECSystems.nl is 2 years. Unless stated otherwise by legal written agreement, known as a SLA. In general there are two kinds of warranty:

Carry-in warranty: The device has to be delivered at ECSystems.nl and will be shipped to the manufacturer for repair, additional shipping costs will be billed;

On-site warranty: The device will be repaired on site. This service may be provided by a third party.
